Purpose of the T&Cs
The Terms and Conditions (T&Cs) apply exclusively to the online sale of NOOANCE products on the website nooance-paris.com, which is accessible to users.
Scope of the T&Cs
The T&Cs exclusively govern the online sales contracts of NOOANCE products to buyers who are consumers and, together with the online order, constitute the enforceable contractual documents to the parties, excluding any other documents, prospectuses, catalogues or photographs of products which are for indicative purposes only.
The T&Cs apply exclusively to products delivered to consumers established in France and internationally.
The T&Cs and all the contractual information mentioned on the site are written in French.
Availability and Enforceability of the T&Cs
The T&Cs are made directly available to consumers on the seller's website. The T&Cs are enforceable against the consumer who acknowledges, by ticking a box provided for this purpose, that they have read and accepted them before placing an order.
Order confirmation by the buyer signifies acceptance of the T&Cs in force on the date of the order, which are preserved and reproduced by the professional seller in accordance with Article 1127-2 of the Civil Code (formerly Art. 1369-4).
Modification of the T&Cs
These T&Cs were last updated on 12 September 2022. The professional seller reserves the right to modify its T&Cs at any time.
In case of modification, the applicable T&Cs are those in effect on the date of the order, a dated copy of which can be provided to the consumer upon request.
Clauses of the T&Cs
The invalidity of a contractual clause does not lead to the invalidity of the T&Cs. The temporary or permanent non-application of one or more clauses of the T&Cs by the professional seller shall not be deemed a waiver of the other clauses of the T&Cs which continue to have effect.
Characteristics
Products for sale are presented in the catalogue published on the site with a description mentioning their essential characteristics in accordance with Article L. 111-1 of the Consumer Code. The photographs illustrating the products do not constitute a contractual document.
Product Use
The site offers products for personal care intended for individuals only. NOOANCE will not be liable for damages caused by improper use of the products sold on its site or by non-compliance with usage precautions.
Conformity
Products comply with the regulations in force regarding the safety and health of persons, the fairness of commercial transactions, and consumer protection at the time of their marketing. Products comply with the provisions of French law in force at the time of their marketing.
Stock Availability
Products are offered and delivered subject to available stock. In case of unavailability of the ordered product, the seller immediately informs the buyer and may offer a product of equivalent quality and price or, failing that, a voucher for the amount of the order usable for any future order. If the buyer disagrees, the seller will refund the amounts paid within 30 working days. Beyond the refund of the price of the unavailable product, the seller is not liable for any cancellation compensation, unless the non-performance of the contract is personally attributable to them.
Resale of Products
Products sold on the site may not be resold without the written agreement of NOOANCE.
Sale Prices
Sale prices, according to Article L. 112-1 of the Consumer Code, are indicated for each product in the electronic catalogue in euros including all taxes, excluding delivery and transportation costs mentioned before order validation and charged in addition.
The total amount due by the consumer is indicated on the order confirmation page.
The sale price of the product is the one in effect on the day of the order. The sale price of the products does not include shipping costs charged in addition to the price. In case of a price promotion, the professional seller commits to apply the promotional price to any order placed during the promotion period.
Modification
The professional seller reserves the right to modify its prices at any time while guaranteeing the consumer the application of the price in effect on the day of the order.
Fees
Additional costs of transport, delivery, or postage (to which other possible costs borne by the seller may be added), of which the client has been made aware before the order, are set on the order form.
Archiving and Proof
The archiving of communications, orders, and invoices is carried out on a reliable and durable medium so as to constitute a faithful and durable copy in accordance with Article 1360 of the Civil Code (formerly Art. 1348). These communications, orders, and invoices can be produced as proof of the contract.
PAYMENT
Exigibility
The price is due in full after confirmation of the order. Payment is made immediately upon ordering by credit card or Paypal.
Payment Security
The site is equipped with a system for securing online payments that allows the consumer to encrypt the transmission of their banking data via the payment platform's secure server. At no time will the consumer's banking data pass through NOOANCE's computer system.

DELIVERY
Delivery is understood as the transfer to the consumer of the physical possession of the goods.
Dispatch Time
Under normal conditions, the professional seller will process the order as soon as possible from Monday to Friday, excluding public holidays. NOOANCE commits to dispatching orders within 24 working hours following the validation of the order, subject to stock availability.
Delivery Time
The prepared order will be handed over to La Poste or its subsidiaries (Colissimo, Chronopost, etc.) or to Mondial Relay, at the customer's choice, for delivery within 2 to 3 days in Metropolitan France or Belgium.
International orders will also be dispatched by La Poste or its subsidiaries and delivered by their local partner. Delivery times vary depending on the region or country of delivery.
Orders confirmed before noon are processed the same day and delivered by La Poste to the provided address. After 12 pm, delivery will be made on the evening of the next business day. NOOANCE cannot be held responsible if delivery is not possible due to the customer's fault.
To facilitate the delivery of the order by the carrier, the customer agrees to make the necessary efforts to allow for the parcel's delivery: ensuring their name is visible on the mailbox, providing the access code, and phone number.
Delivery Delay
In case of a delivery delay of more than 5 working days, the customer must inform NOOANCE's customer service, who will implement necessary and appropriate actions.
Delivery Location
Products are delivered to the address specified by the customer on the order form.
Product Conformity
If the product is not in conformity with the order, the consumer must lodge a complaint with the professional seller to obtain a replacement of the product or possibly the resolution of the sale.
Transfer of Ownership
From the delivery date indicated on the order form, ownership of the product is transferred to the buyer, except in cases where full payment of the price has not been received at the time of the order.
RETURN OF PRODUCTS & RIGHT OF WITHDRAWAL
The consumer has the right to return an item within fourteen days from the date of receiving their order to return any product that does not suit them and request an exchange or refund, except for the cost of return shipping which remains their responsibility.
The right of withdrawal can be exercised with our customer service directly through our website in the "Contact Us" section. We will promptly send you an acknowledgment of the withdrawal on a durable medium (for example, by email).
Returns must be made in their original and complete condition, allowing them to be resold as new. Any product that has been opened or damaged by the consumer will not be accepted.
In the event of a withdrawal, NOOANCE will refund all payments received, either by re-crediting the consumer's credit card or PayPal account, or by bank transfer depending on the payment method of the order.
NOOANCE may defer the refund until the products are received and verified.
PROCESSING OF PERSONAL DATA
NOOANCE processes information about consumers in accordance with its Privacy Policy.
DISPUTE RESOLUTION
NOOANCE will not be held liable for damages resulting from non-compliant use of its products. In case of a dispute, you should first contact the company's customer service by email at bonjour@nooance-paris.com to try to resolve the dispute informally.
APPLICABLE LAW
This contract and the T&Cs governing it are subject to French law.
